General Terms and Conditions for Booking Airport Tours at Stuttgart Airport

1. Validity

These General Terms and Conditions (‘GTC’) shall apply to all contracts concluded between Flughafen Stuttgart GmbH (Flughafenstrasse 32, 70629 Stuttgart, Germany) – hereinafter referred to as FSG – and the purchaser of an airport tour.

 

2. Scope of services

2.1 FSG offers guided tours of the airport for a fee.

2.2 All available airport tours can be booked online. Various tours are available; the content and the available airport tours can be found on the website.

 

3.  Booking conditions

3.1 The provision of the online ordering platform and the proposed airport tours does not represent a legally binding offer from FSG. It is only a non-binding solicitation of the customer.

3.2 Once the customer submits the required information into the provided order form, provides the payment information and confirms the order by clicking the ‘confirm booking’ button at the end of the ordering process, the customer issues a binding and irrevocable offer to conclude a contract for the specified number of participants. Until the ‘confirm booking’ button is clicked, the ordering process can be cancelled/terminated by the customer at any time by clicking the ‘cancel’ button or switching to another Internet website.

3.3 Acceptance of the offer is communicated by an email sent by FSG in which the tour is confirmed. Only at this point will a binding contract be concluded.

 

4. Fee

4.1 For each booking, a fee is shown in the booking form. Payment of the fee is due immediately.

4.2 Payment can be made by invoice, credit card or on site at the Skyland checkout. Invoicing usually takes place after booking. In the case of bank transfer, the invoice amount is to be transferred to the account stated in the invoice after receipt of the invoice. The invoice amount must be received in the FSG account at least 7 days before the start of the tour. If payment is made on site, the tour must be paid for at the Skyland ticket office before the tour begins. The following payment methods are available: cash, EC and credit cards as well as Apple and Google Pay.

 

5. Right of withdrawal

According to Section 312g (2)(9) of the German Civil Code (BGB), there is no right of withdrawal for this contract configuration. The customer cannot revoke their order/booking.

 

6. Cancellations by the customer

6.1 Cancellations by the customer are free of charge up to seven working days before the start of the tour.

6.2 If the customer cancels later than seven working days before the start of the tour, a cancellation fee of 100% of the original invoice amount will be charged.

6.3 If the customer does not present themselves for the booked tour or the customer cancels on the day of the booked tour, the original amount will be charged in full.

6.4 Cancellations must be submitted in writing to Flughafen Stuttgart GmbH.

 

7. Cancellations by FSG

7.1 The undisrupted operation of the airport and the safety of passengers and guests take absolute priority over the airport tours. FSG therefore reserves the right to change or cancel airport tours due to weather conditions, safety-related events, operational reasons, official orders, or other similar reasons. In the event of a cancellation, FSG will endeavour to find an alternative date. If no alternative date is found, there will be no charge.

7.2 FSG has the right to interrupt or cancel the airport tour at any time if there is a risk that it cannot be properly conducted due to the conduct of the group or of individual participants. If the tour cannot be started for the above reasons or if the tour must be cancelled, the full booking price must be paid.

7.3 For individual tours, the maximum number of participants is 30 and the minimum number of participants is 10. If, contrary to the registration, other persons are present, they cannot take part in the tour. If the minimum number of 10 participants is not reached, Stuttgart Airport reserves the right to cancel the tour up to 7 days before the tour date. Any ticket prices paid in advance will  be refunded.

8. Conducting the airport tour

8.1 The booked airport tours can only be conducted properly if the participants arrive on time at the agreed meeting point. Therefore, please be at the agreed meeting point at the latest by the time of the booked appointment. You will find a map of the meeting point on our website.

8.2 In the event of delays of more than ten minutes, the airport tour can no longer be guaranteed. Should this occur, the booking price must be paid.

8.3 The starting times can be adjusted by FSG at any time for operational reasons.

 

9. Privacy policy for booking and conducting airport tours at Stuttgart Airport

10. Liability

10.1 FSG shall be liable for damages due to intent or gross negligence in accordance with the statutory provisions. The liability of FSG for slight negligence on the part of FSG or one of its vicarious agents shall be limited to the foreseeable damage typical for the contract in the event of a breach of a material contractual obligation and is otherwise excluded. Liability for damages resulting from injury to life, body or health remains unaffected.

10.2 FSG shall not be liable for any damage caused by force majeure or other causes beyond its control, such as interventions by the aviation authorities or other authorities.

 

11. Other provisions

11.1 The customer may only assert rights of retention on the basis of counterclaims arising directly from this contract. The customer may only offset claims by FSG against uncontested or legally established claims.

11.2 In addition, the FSG airport user regulations and house rules, which are published on our website, apply.

11.3 You will find the applicable safety instructions in the registration information sent with the booking confirmation. The service cannot be provided unless compliance with these safety instructions is observed. The safety instructions shall also become the contractual basis.

11.4 Ancillary agreements and amendments must be made in writing unless otherwise agreed in these General Terms and Conditions. This also applies to the waiver or modification of the written form requirement.

11.5 The performance of FSG is subject exclusively to German law.

11.6 The place of performance is exclusively the premises of Stuttgart Airport. The place of jurisdiction for both parties shall be determined exclusively according to this place of performance.

11.7 Should the provisions of a contract be invalid or void, the validity of the remaining provisions shall not be affected. However, the entire contract shall become void if adherence to the contract, even after the additional application of the default rule, constitutes an unreasonable hardship for one of the contracting parties or the gap cannot be reconciled by default rule or supplementary contract interpretation.

11.8 Information on online dispute resolution

The European Commission provides an online dispute resolution platform, which can be found at https://ec.europa.eu/consumers/odr/main/?event=main.trader.register#inline-nav-2 . This platform serves as a point of contact for the out-of-court settlement of disputes concerning contractual obligations arising from online purchase contracts.

Note according to Section 36 of the German Act on Alternative Dispute Resolution for Consumer Disputes (VSBG)

We are not willing and not required to take part in a dispute settlement procedure before a consumer arbitration body.
